This privacy statement applies to all services that come under Emil Frey Car Trading Netherlands and its affiliated companies, apart from those services where a specific privacy statement that applies to that service is referred to.

We see it as our duty to respect the privacy of our existing and prospective customers and to handle their personal data with care.

In this privacy statement, you will find general information about the way we handle your personal data.

Our goal

Our goal is to give you the best possible service. In order to be able to provide you with a tailored and personal service, we need your personal data.

We naturally ensure that we comply with the latest legislation and regulations that apply to the usage of personal data.

You can trust Emil Frey Car Trading Netherlands and its affiliated companies to handle your personal data with care and be sure that our service provision is transparent, trustworthy and personal.
 

What is personal data?

As soon as data can identify you as a person, this data is called ‘personal data’. Examples of personal data are your name, address, date of birth, bank account number and user name.

In this privacy statement, we will tell you about the way in which we handle your personal data and about the measures we take to protect your personal data.

In this privacy statement, we use the definition ‘data subject’. A data subject is any person whose personal data is processed by Emil Frey Car Trading Netherlands and/or one of its affiliated companies.

Why is your data processed?

We like to communicate with you honestly and transparently about using your personal data.

In the section ‘Retention period for personal data’, we have distinguished between the different data storage categories we deploy.

We only use your personal data for the purposes set out next to this text.

Which personal data of yours do we process?

In order to give you the best possible service and depending on the service that you purchase from us, we will need the following personal data (amongst other information):

External services

Our dealer contracts mean we are obliged to share certain data with the importer and/or car manufacturer. This is done so that product recalls can be carried out, for instance.

In addition, in certain cases we use external service providers, for example for marketing activities or for the financial settlement of those payments for which we use a payment provider. In addition, your data may be provided to affiliated intermediaries and/or to providers of insurance and financing products.

Naturally we make clear arrangements with these parties to ensure they handle your personal data with care. The personal data in question is only used to carry out the service in question.

Retention period for personal data

We do not retain your personal data for longer than necessary.
Our basic principle is that we only retain personal data for as long as is necessary to be able to deliver the service to you. Here, we distinguish between two groups:

Group A - active customers

These are the customers in the category of ‘less than 48 months since a purchase or service visit’. This 48-month period stems from the average period of time a vehicle is used for and from the obligatory APK (periodic vehicle inspection) that must be carried out.

Group B – non-active customers

These are the customers who on the basis of consent have given us their unambiguous consent to receive specific product and/or services information.

For the other non-active customers, only the statutory retention period applies (84 months). This group will not be contacted any more.​

In some cases, we are under a statutory obligation to retain personal data for longer periods. For example, tax legislation requires us to retain fiscally relevant personal data for seven years.

When it comes to data obtained on prospective customers, we only use it for the purpose for which it was provided and do not retain it longer than 18 months.

How is your personal data protected?

Emil Frey Car Trading Netherlands and its affiliated companies have implemented suitable technical and organisational measures to protect your personal data. We naturally do all we can to protect your personal data optimally against unauthorised access, loss or theft.

The staff of Emil Frey Car Trading Netherlands and its affiliated companies can only access your personal data when it is strictly necessary for them to do so.

If your personal data is being processed by an external party then we will have reached agreement with him about the way in which your data is to be protected. If we bring in an external party for our services who processes personal data then we will make sure that this party complies with our data security requirements too.
